ICE HSI Investigation Leads to Conviction of Illegal Alien for Child Pornography in Minnesota

This illegal alien had numerous storage devices with child sexual abuse material in his apartment, with one hidden inside a crucifix

WASHINGTON – The United States Department of Homeland Security (DHS) issued the following statement after an investigation by U.S. Immigration and Customs Enforcement’s (ICE) Homeland Security Investigations (HSI) led to an illegal alien being convicted for child pornography in Minnesota.

The U.S. Attorney’s Office for the District of Minnesota announced that on October 8, a federal jury found Alejandro Rojas Garcia, an illegal alien from Mexico, guilty of attempted production of child pornography.

According to federal documents and evidence presented during the four-day trial, the investigation began in April 2024 after it was alleged that Garcia had sexually assaulted two sisters who were under the age of 13. Upon Garcia’s arrest on April 5, 2024, officers searched his apartment and found multiple cell phones, cameras, laptop computers, flash drives, and other data storage devices. They also found multiple hidden cameras throughout the apartment, including five hidden in the bathroom.

Upon searching the storage devices, officers found numerous depictions of child sexual abuse material (CSAM). One of the storage devices, a micro-SD card, was hidden inside a crucifix.

Garcia now faces a mandatory minimum sentence of 15 years in prison. His sentencing will be set at a later date. In addition to the federal charges, he is also facing state criminal charges for related conduct.

“This pedophile was just convicted for attempted production of child pornography in Minnesota,” said DHS Secretary Markwayne Mullin. “Thanks to the brave men and women of HSI, as well as our local partners and the men and women at the Department of Justice, this illegal alien will face justice for his crimes. Once he finishes his sentence, he will be deported so that he cannot harm another child in America ever again.”

“Garcia is a predator,” said U.S. Attorney Daniel N. Rosen. “A verdict cannot undo the evil he brought on two innocent girls, but it is justice.”

Garcia obtained a B-2 visa in January 2002. He entered the United States at an unknown date and location.

This case was the result of an investigation by HSI and the Stillwater Police Department, with assistance from Washington County Child Protective Services.

Under Governor Tim Walz, Minnesota has become a hotbed of illegal alien crime. Recent examples of illegal alien crime in the state include:

  • In June, Governor Walz and the Minnesota Clemency Review Commission granted a pardon to Tou Lue Vang, an illegal alien from Laos, who had been convicted for first-degree criminal sexual conduct after he repeatedly sexually assaulted a 10-year-old girl. In July, ICE deported Vang back to Laos.
  • In June, ICE arrested Georgii Gabiev, an illegal alien from Russia, who caused a fatal truck crash in 2024 that killed American truck driver Tim Tarnowski in Chippewa County.
  • In June, Governor Walz and the Minnesota Clemency Review Commission granted a pardon to Jai Vang, an illegal alien from Laos, whose criminal record includes felony convictions for robbery and robbery of a business with a gun, as well as a conviction for driving under the influence of liquor.
  • In April, ICE arrested THREE illegal aliens convicted of sex crimes against children in a single day: Rene Rosario-Miranda, an illegal alien from Guatemala convicted for third-degree aggravated sexual abuse of a minor; Axel Javier Martinez-Castillo, an illegal alien from Honduras whose criminal history includes the sexual assault of a 7-year-old; and Rene Flores-Lue, an illegal alien from El Salvador and a convicted rapist of a 5-year-old.
  • In February, ICE arrested Morris Brown, an illegal alien from Liberia and serial immigration fraudster, who was working as a Minnesota correctional officer despite having no legal status in the United States.
  • In June 2025, ICE arrested Roberto Carlos Munoz-Guatemala, an illegal alien from Mexico, after he dragged an ICE officer 50 yards with his car in an attempt to flee law enforcement. His criminal history includes a conviction for sex crimes against an underage teenager and an arrest for domestic assault.
